Plaintiff Files Product Liability Lawsuit Against Walmart Over “Exploding” Candle

A woman says she sustained severe injuries from an “exploding candle” she purchased from Walmart. The plaintiff filed a product liability lawsuit against the retail giant, claiming that a $4 candle she purchased from the company exploded and caused her harm. According to the suit, the woman was afraid for her safety when a Mainstays candle she had purchased exploded. The woman said she was afraid the fire would burn down her entire house. Her lawsuit claims that the candles from Walmart are exploding because they’re getting too hot. The plaintiff also said that she sustained second-degree burns as a result of the exploding candle.

According to the plaintiff, she had burned the candle for only an hour when it suddenly began to produce flames that were high enough to leave soot on her ceiling. According to the lawsuit, the flames were not merely coming from the wick but appeared to have ignited the wax somehow. Upon seeing abnormally high flames, the plaintiff proceeded to remove the candle to her kitchen sink. That’s where she said it exploded. The plaintiff says that the explosion sent fiery wax flying through the room, striking her thigh. As a result, she suffered second-degree burns on her thigh from the explosion.

Walmart and product liability lawsuits 

Walmart sells millions of products each year to consumers. Some of these products are unnecessarily dangerous to the public. The plaintiff contends that the Mainstays brand candles are intrinsically defective, burn too hot, and are prone to exploding. Is Walmart liable for her injuries?

Under the rules of product liability, Walmart (a retailer) can be held liable for making defective products available to the public. A lawsuit can also be filed against the manufacturer of the product.

Such lawsuits are filed under one of three theories of product liability. You can argue that a product is intrinsically defective and unsafe for the public. You can also argue that a product has a manufacturing defect that renders it unsafe for public consumption. Finally, you can argue that a company failed to warn customers about a potential danger related to their product.

In this case, the product did come with warnings, but nothing that would have alerted the plaintiff to the fact that the product was dangerous. Generally speaking, companies are strictly liable for injuries that their products cause. That means that plaintiffs do not need to prove negligence. They only need to prove that they were using the product in a way that could be readily anticipated by the company that manufactured it. In the process of using the product in a way that could be readily anticipated by the company that manufactured it, they sustained an injury.
