Tracy Morgan Secures $90 Million Settlement After Truck Accident with Walmart Vehicle

Tracy Morgan, renowned stand-up comedian and television actor, was recently involved in a truck accident with a Walmart vehicle which left him critically injured and took the life of his long-time friend Jimmy McNair. According to the lawsuit, the crash was caused by the truck driver who had reportedly been awake for more than 24 hours before the incident and was speeding to meet a delivery deadline. His fatigue played a significant role in the tragic crash, which also claimed the life of McNair, who is known as Jimmy Mack within the comedy community.

According to reports, Morgan sustained multiple broken bones, including a severely damaged leg, fractured ribs, and a traumatic brain injury. He had to be placed in a medically induced coma for two weeks. After that he embarked on a long and difficult journey of recovery, undergoing surgeries, physical therapy, and rehabilitation.

“I was in a coma for two weeks, and the doctors told my family they didn’t know if I would make it. I woke up, and I couldn’t even walk,” Morgan said in an interview. “I had to learn how to walk again. It was the hardest thing I’ve ever done.”

Walmart’s responsibility for the accident

  Morgan and his legal team filed a lawsuit against Walmart claiming that the company was responsible for the accident due to its negligence and allowing an overworked and fatigued driver to operate the truck. According to investigations, the driver had been working consecutive shifts and had violated federal safety regulations set by the federal motor carrier safety administration (FMCSA), including the 34 hour restart rule meant to reduce driver fatigue.

“The fact that Walmart allowed this driver to be on the road at the time of the accident speaks volumes about their safety practices,” said Morgan’s attorney. “They failed to properly monitor their drivers and allowed them to work beyond the safe limits.”

In addition to working extended hours, investigations revealed that the trucking industry as a whole has been under scrutiny for poor safety practices. Ultimately, Morgan was able to reach a settlement with Walmart for $90 million. The settlement award provided Morgan with the financial resources necessary to continue his recovery and future endeavors. Morgan’s legal team emphasized that the financial compensation was necessary to address physical, emotional, and financial damage caused by the accident.

All companies are responsible for the conduct of their drivers. This means that a company like Walmart is responsible when their driver violates federal safety standards and works without resting for an extended period of time. In this case, Walmart settled the matter for $90 million, which is a very large settlement for a truck accident lawsuit.
